THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
1. OUR LEGAL DUTY
CBRC LLC d/b/a Carlsbad Beach Recovery (“we,” “our,” or “us”) is required by law to maintain the privacy and security of your Protected Health Information (“PHI”) and to provide you with this Notice of Privacy Practices.
We are required to:
- Maintain the privacy of your PHI
- Provide you with notice of our legal duties and privacy practices
- Notify you following a breach of unsecured PHI when required by law
- Follow the terms of this Notice currently in effect
2. WHAT IS PROTECTED HEALTH INFORMATION (PHI)
Protected Health Information (“PHI”) includes information that:
- Identifies you or could reasonably identify you; and
- Relates to your past, present, or future physical or mental health condition, treatment, or payment for care
3. HOW WE MAY USE AND DISCLOSE YOUR PHI
We may use and disclose your PHI without your written authorization for the following purposes:
A. Treatment
We may use and share your PHI to provide, coordinate, or manage your healthcare.
Example: Communicating with clinicians, therapists, referring providers, or recovery support personnel involved in your care.
B. Payment
We may use and disclose your PHI to obtain payment for services.
Example: Submitting information to your insurance provider to verify coverage, obtain authorization, or process claims.
C. Healthcare Operations
We may use your PHI for our healthcare operations.
Examples include:
- Quality assessment and improvement activities
- Staff training and supervision
- Licensing, accreditation, and compliance reviews
- Business management and administrative functions
D. Appointment Reminders and Communications
We may use your PHI to contact you regarding:
- Appointment reminders
- Treatment-related communications
- Follow-up care and administrative matters
E. Individuals Involved in Your Care
We may share PHI with family members, relatives, close friends, or other individuals you identify as involved in your care, if:
- You agree;
- You are given an opportunity to object and do not; or
- We determine it is in your best interest in an emergency situation
F. Public Health and Safety
We may disclose PHI when necessary to:
- Prevent or reduce a serious threat to your health or safety or that of others
- Report abuse, neglect, or domestic violence
- Comply with public health reporting requirements
G. Health Oversight Activities
We may disclose PHI to government agencies for oversight activities such as:
- Audits
- Investigations
- Inspections
- Licensing and certification reviews
H. Legal Proceedings and Law Enforcement
We may disclose PHI:
- In response to court orders, subpoenas, or other lawful processes
- To law enforcement officials as permitted by law
I. Required by Law
We will disclose PHI when required to do so by applicable federal, state, or local law.
J. Additional Permitted Disclosures
We may also disclose PHI as permitted by law for purposes including:
- Workers’ compensation programs
- Public health reporting and communicable disease control
- Regulatory and accreditation requirements
- National security and other specialized government functions
K. Business Associates
We may share PHI with third-party service providers (“Business Associates”) who perform services on our behalf. These parties are required to protect your PHI under HIPAA-compliant Business Associate Agreements.
4. USES AND DISCLOSURES THAT REQUIRE YOUR AUTHORIZATION
We will not use or disclose your PHI without your written authorization for:
- Marketing purposes (where required by law)
- The sale of PHI
- Most disclosures of psychotherapy notes (if applicable)
You may revoke your authorization at any time in writing, except to the extent that we have already relied on it.
5. YOUR RIGHTS REGARDING YOUR PHI
You have the following rights:
A. Right to Access
You have the right to inspect and obtain a copy of your PHI.
We may charge a reasonable, cost-based fee for copies.
B. Right to Amend
You may request that we correct or amend your PHI if you believe it is inaccurate or incomplete.
C. Right to an Accounting of Disclosures
You may request a list of certain disclosures we have made of your PHI.
D. Right to Request Restrictions
You may request limits on how we use or disclose your PHI.
We are not required to agree, except where required by law.
E. Right to Confidential Communications
You may request that we contact you in a specific way (for example, only by phone or at a specific address). We will accommodate reasonable requests.
F. Right to a Paper Copy
You may request a paper copy of this Notice at any time.
G. How to Exercise Your Rights
Requests described in this section must be submitted in writing using the contact information provided below. We may require verification of your identity prior to fulfilling such requests.
6. SPECIAL PROTECTIONS FOR SUBSTANCE USE DISORDER RECORDS
To the extent applicable, records related to substance use disorder treatment may be subject to additional protections under 42 CFR Part 2.
These records:
- May not be disclosed without your written consent, except as permitted by law
- Are subject to stricter confidentiality requirements than general PHI
7. BREACH NOTIFICATION
If a breach of your unsecured PHI occurs, we will notify you as required by applicable law.
8. CHANGES TO THIS NOTICE
We reserve the right to change this Notice at any time. Any revised Notice will apply to all PHI we maintain and will be made available upon request and on our website.

If you believe your privacy rights have been violated, you may file a complaint with:
